Definitions
In these Terms, unless the context requires otherwise:
- "Operator" means Dama N.V., a public limited company incorporated under the laws of Curaçao with registration number 152125 and registered address at Scharlooweg 39, Willemstad, Curaçao, operating the online casino under the brand name "Bitstarz" via the domain bitstarzbet-au.com. References to "we", "us" and "our" are to the Operator, and, where relevant, to its wholly owned subsidiary Friolion Limited (Leandrou, 12A 3086, Limassol, Cyprus) acting as a payment processor.
- "Website" means the site located at https://bitstarzbet-au.com and any mobile or other version of that site made available to you.
- "Bitstarz" means the Australian-facing version of the Bitstarz online casino offered exclusively via the Website.
- "User", "you", "your" means any natural person who accesses the Website, creates an account, or otherwise uses the services offered on the Website.
- "Player" means a User who has successfully registered an account and placed at least one real-money or bonus-funded wager on the Website.
- "Account" means a personal, single-player account opened and maintained in your name with the Operator for the purpose of participating in games and managing funds.

- "Bet" or "Wager" means any amount of real money or bonus funds staked by you on the outcome of a Game offered on the Website.

- "Bonus Funds" means the non-withdrawable portion of your balance consisting of Bonuses and any winnings derived from such Bonuses until the applicable wagering requirements are met.
- "Real Money Balance" means the portion of your Account balance that consists of your own deposits and winnings from wagers that are not subject to any ongoing wagering requirements.

2. Account Registration
2.1 Eligibility and Age Requirements
- Minimum age: You may only register and use an Account if you are at least 18 years old or older than the minimum legal gambling age in your place of residence, whichever is higher. By creating an Account, you confirm and warrant that you meet this requirement.
- Australian users: You acknowledge that online gambling is regulated in Australia and that it is your responsibility to ensure that your use of the Website is lawful in your state or territory. - Prohibited users: You must not create an Account if:

2.2 Account Creation Process

- Single account rule: You are permitted to hold only one Account with the Operator. Creating multiple Accounts (including using different email addresses or identities) is strictly prohibited and may result in closure of all related Accounts, cancellation of winnings, and forfeiture of Bonuses.
2.3 KYC and Verification
- Verification requirement: We may, at any time, require you to complete KYC checks. This may include submitting:
- a valid government-issued photo ID (passport, driver licence, or national ID);
- proof of address (utility bill, bank statement or similar not older than 3 months);
- proof of ownership of Payment Methods used (card copy, account statement, e-wallet screenshot);
- evidence of source of funds or source of wealth where required by our regulatory obligations.
- Timing of checks: We may request KYC documents:
- before your first withdrawal;
- when cumulative deposits or withdrawals exceed certain thresholds;
- if suspicious activity is detected; or
- at any time we deem necessary to comply with anti-money laundering and counter-terrorist financing obligations.
- Non-compliance: Failure to provide accurate and complete KYC documentation within the timeframe specified by us may result in suspension or closure of your Account, withholding of withdrawals, and possible reporting to relevant authorities.
2.4 User Obligations
- Accuracy of data: You must provide true, complete and up-to-date information during registration and keep it updated. If your details change, you must promptly amend them via your Account settings or by contacting [email protected].
- Password security: You must choose a strong password and keep your login credentials confidential. You are solely responsible for all activity conducted under your Account, whether or not authorised by you. You should:
- log out after each session;
- not share your credentials with any third party;
- notify us immediately if you suspect any unauthorised access.
- Use for personal purposes only: Your Account is for your personal, non-commercial use. You must not:
- act on behalf of another person;
- sell, transfer or allow others to use your Account;
- use your Account for any unlawful or fraudulent purpose.
- Compliance with laws: You are responsible for ensuring that your use of the Website complies with all Applicable Laws in your jurisdiction, including any tax obligations arising from your winnings.
6. Betting & Gameplay Rules
6.1 General Rules for Placing Bets
- Real money and Bonus Funds: Bets may be placed using Real Money Balance and, where permitted by a promotion, Bonus Funds. The order in which balances are used (real money first or bonus first) will be specified in the relevant bonus rules or our general bonus policy.
- Minimum and maximum stakes: Each Game has its own minimum and maximum stake limits as displayed in the Game interface. You agree that:
- you may not place bets below the minimum or above the maximum permitted by the Game or by our general risk management rules;
- we may change betting limits at any time for technical, regulatory or risk reasons.
- Bet acceptance: A bet is deemed accepted only when it is processed by our servers and confirmed in your Game history. If there is any discrepancy between your display and our server records, the server records will prevail.
6.2 Cancellation and Modification of Bets
- User-initiated cancellation: Once a bet has been accepted by our system, you cannot cancel or modify it, unless a specific Game provides an in-built feature allowing early cash-out or similar options.
- Operator-initiated cancellation: We may void or cancel a bet, or a series of bets, in whole or in part if:
- a technical failure (including but not limited to system errors, incorrect Game configuration or obvious pricing errors) has occurred;
- the bet was accepted when you had insufficient balance;
- you were in material breach of these Terms at the time the bet was placed;
- the bet was placed after the outcome of the Game was known or should reasonably have been known.
- Refunds in case of malfunction: Where a Game malfunctions or is interrupted due to technical problems, the bet may be refunded or the Game instance may be restored to its last known state, subject to the underlying game provider's rules.
6.3 Game Rules and Fairness
- Game-specific rules: Each Game is governed by its own rules, paytables and return-to-player (RTP) information, available within the Game interface. By playing a Game, you agree to its specific rules.
- Random number generator (RNG): Except for live dealer Games, outcomes are determined by a certified RNG supplied by licensed providers. While the Operator is licensed in Curaçao under e-gaming licence 8048/JAZ2020-013 (valid until at least 31 December 2026, subject to regulatory transition), we do not guarantee that any particular Game will be available or approved in your jurisdiction.
6.4 Conduct in Live Casino and Chats
- Respectful behaviour: When using live casino Games, chat functions or interacting with support, you must:
- refrain from abusive, obscene, racist, sexist, threatening, defamatory or otherwise offensive language;
- not harass, intimidate or insult dealers, other players or staff;
- not promote other websites, products or services.
- Prohibition of fraud and collusion: You must not:
- engage in any fraudulent activity, including chargebacks, use of stolen payment instruments, or identity theft;
- collude with other players or manipulate Game outcomes;
- use bots, scripts, automated systems or any devices designed to gain an unfair advantage.
- Breaches: We may mute chat, remove your access to particular Games, forfeit winnings, and/or suspend or close your Account if you violate these conduct rules.
11. Bonus Terms
11.1 General Bonus Principles
- Separate terms: Each Bonus is subject to these general Bonus Terms and any specific promotion rules published on the Website at the time the Bonus is offered. In the event of inconsistency, the specific promotion rules prevail.
- Availability to Australian players: Certain Bonuses may not be offered or may be restricted for Australian players, depending on regulatory guidance and our internal risk policies. The Website will indicate where a promotion is not available to you.
- One per person: Unless expressly stated otherwise, Bonuses are limited to one per person, household, IP address, device and payment details.
11.2 Bonus Activation and Wagering Requirements

- Wagering requirements: Unless specified otherwise:

11.3 Prohibited Games and Actions with Bonuses

- Irregular play: The following actions are typically considered "irregular play" and may lead to confiscation of Bonuses and winnings:
- placing single bets that are disproportionately large relative to the bonus amount or remaining wagering requirements, beyond the maximum bet per spin/round stated in the bonus rules;
- using betting strategies to artificially extend playtime, minimise risk or guarantee profits (for example, betting on both red and black in the same roulette spin);
- delaying Game rounds, free spin features or bonus features to a later time when wagering has been completed.
- Abuse and multiple Accounts: Bonus abuse, including but not limited to multiple Account creation, collusion, or exploitation of software errors, is strictly prohibited and may result in Account closure, cancellation of Bonuses, and forfeiture of winnings.
11.4 Combining Promotions
- No stacking unless allowed: Only one active deposit-related Bonus may be in effect at a time, unless expressly stated otherwise. You may not combine multiple deposit Bonuses for the same deposit.
- Order of application: Where multiple non-conflicting promotions are available (for example, a reload Bonus and a separate cashback offer), the Website or support team will clarify how they apply and in which order. Some promotions may not be usable in conjunction with others.
- Opt-out: You may decline or cancel a Bonus before you start playing with it, by contacting [email protected] or using available controls. Cancelling a Bonus after you have started to wager with it may result in forfeiture of the Bonus and any associated winnings, subject to the applicable rules.
9. Payments & Withdrawals
9.1 Deposit Methods and Conditions
- Payment Methods: We may offer a range of Payment Methods to Australian players, which can include:
- credit and debit cards processed via our payment subsidiary Friolion Limited (Cyprus);
- selected e-wallets and payment services;
- bank transfers; and
- supported cryptocurrencies.
- Ownership of funds: You may only deposit funds that belong to you and originate from lawful sources. Using third-party Payment Methods without their explicit authorisation is strictly prohibited.
- Deposit limits: Minimum and maximum deposit amounts for each Payment Method are displayed in the cashier. We may impose additional limits to comply with legal, regulatory or responsible gambling requirements.
9.2 Withdrawals
- General rule: You may request withdrawals of your Real Money Balance subject to:
- successful completion of any required KYC checks;
- completion of wagering requirements for any active Bonuses; and
- compliance with these Terms.
- Payment routes: Wherever reasonably possible, withdrawals will be processed via the same Payment Method(s) used for deposits. If this is not possible, we may offer an alternative method at our discretion.

9.3 Fees and Currency
- Fees: The Operator aims to process deposits and withdrawals without charging additional fees. However:
- your bank, card issuer or payment provider may charge its own fees or currency conversion costs, which we do not control;
- we reserve the right to charge reasonable administrative fees for repeated withdrawal requests without gaming activity, or for processing withdrawals of funds that have not been subject to sufficient gameplay to satisfy anti-money laundering considerations.
- Currency: Your Account will be denominated in one of the currencies offered on the Website. If your Payment Method is in a different currency, deposits and withdrawals may be converted at prevailing exchange rates used by our payment processors or your bank.
9.4 Refunds of Bets, Deposits and Bonuses
- Refunds of deposits: As a general policy, deposits are non-refundable once wagered. We may, at our sole discretion and subject to anti-money laundering controls, consider refund requests in exceptional circumstances. Any refund may be net of transaction costs and may result in cancellation of related Bonuses and winnings.
- Refunds due to technical issues: If a bet or Game round is invalidated due to a confirmed technical or operational error, we may:

- restore the Game to its last known fair state, where technically feasible.

Limitation of Liability
Scope of Our Obligations
- Provision of services: We will provide the Website and Games with reasonable skill and care and in accordance with Applicable Law and our Curaçao e-gaming licence 8048/JAZ2020-013 as amended or extended at least until 31 December 2026.

- if the claim does not relate to a specific bet, the lesser of your net deposits in the preceding 30 days and AUD 1,000 (or equivalent in your Account currency).
- User responsibility: You acknowledge that:

Permitted and Prohibited Use

- Prohibited actions: You must not, without our prior written consent:

14. Termination & Suspension
14.1 Termination by You
- Account closure: You may at any time request to close your Account by contacting [email protected]. We may require that all pending bets are settled and that any outstanding KYC checks are completed before closure.
- Withdrawal on closure: On request, and subject to these Terms and Applicable Law, we will pay out your Real Money Balance using an appropriate Payment Method. Any active Bonuses and associated Bonus Funds may be cancelled and forfeited upon closure.
14.2 Suspension and Termination by the Operator
- Grounds for suspension or closure: We may suspend, restrict or close your Account, and/or withhold funds where:

- we suspect fraud, money laundering, terrorist financing or other unlawful activity;
- you have provided false, misleading or incomplete information;
- you have self-excluded or requested a break from gambling;

- Effects of suspension: During suspension, you may be unable to deposit, withdraw or place bets, although you may still be required to cooperate with KYC or other investigations.
14.3 Refund of Funds upon Closure
- Lawful closure: Where your Account is closed and no unlawful activity is identified, we will, subject to Applicable Law:
- pay out your Real Money Balance via an appropriate Payment Method; and
- cancel any Bonuses and associated Bonus Funds.
- Unlawful or fraudulent activity: Where we reasonably determine that you have engaged in fraud, money laundering, breach of law or serious violation of these Terms, we may:
- void bets and confiscate winnings and Bonuses; and
- withhold balances where required by law or regulatory guidance and/or report the matter to relevant authorities.
14.4 Notice
- Notification: We will use reasonable efforts to notify you of any decision to suspend or close your Account, stating the main reasons where legally permitted, by email to your registered address or by in-site message.

4. Governing Law & Jurisdiction
4.1 Governing Law
- Primary governing law: These Terms, your Account, and all transactions with the Operator are governed by the laws of Curaçao, excluding its conflict of law rules.
- Australian mandatory laws: For Users habitually resident in Australia, nothing in these Terms limits or excludes any protection, right or remedy that cannot be excluded under Australian law, including the Australian Consumer Law. Where there is a conflict between Curaçao law and any non-excludable Australian law, the latter will prevail to the extent of the inconsistency.
4.2 Dispute Resolution

- a clear description of the issue; and

- Consumer rights in Australia: If you are an Australian consumer and Applicable Law grants you the right to bring proceedings in Australian courts, these Terms do not restrict that right.
